This Privacy Statement describes how Bidmax U collects and processes your personal data through the Bidmax U websites and applications mentioned in this Privacy Statement. Bidmax U refers to the ecosystem consisting of Bidmax U websites, mobile applications, clients, applets and other applications developed to provide Bidmax U services, including independently operated platforms, websites and clients within the ecosystem (such as Bidmax U’s Open Platform, Bidmax U Launchpad, Bidmax U Labs, Bidmax U Charity, Bidmax U DEX, Bidmax U X, JEX and Fiat Gateway).

This Privacy Statement applies to all personal data processing activities we carry out on the Bidmax U platforms, websites and departments.

If you are a customer or user of our services, this Privacy Statement applies together with any business terms and other contractual documents, including but not limited to any agreement we have with you.

2. What personal information does Bidmax U collect and process?

Personal information is data that identifies or relates to an identifiable individual. This includes information you provide to us, information collected about you automatically, and information we obtain from third parties.

Information you provide to us. To open an account and access our services, we will ask you to provide us with some information about yourself. This information is either required by law (for example, to verify your identity and comply with “know your customer” obligations), necessary to provide the requested service (for example, you need to provide your email address to open your account), or related to certain specific purposes, which are described in more detail below. In some cases, if we add services and features, you may be asked to provide us with more information.

If you fail to provide the required data, Bidmax U will not be able to provide you with our services.

For example, if you want to exchange cryptocurrency for fiat currency and withdraw it to your bank account, we may need to exchange information with Binance Connect. We may analyze public blockchain data, such as transaction ID, transaction amount, wallet address, timestamp, or transaction or event.

Retailer information

When you conduct transactions with third-party merchants, merchants may provide us with your personal information, such as name, contact details, transaction information.

3. Why does Bidmax U process my personal data? What legal basis do we rely on to collect and process your personal data?

Our main purpose for collecting personal information is to provide our services in a safe, efficient and smooth manner. We generally use your personal information to deliver, provide, operate our services, and for content and advertising, as well as for loss prevention and anti-fraud purposes. Below you will find an explanation of how we use automated personal decision-making, including profiling. Bidmax U does not rely entirely on automated tools to help determine whether a transaction or customer account is at risk of fraud or legal risk.

Why does Bidmax U process my personal data?

– Manage our contractual relationship with you. Create and maintain your account.

This includes where we use your personal data to receive and process orders and to process payments.

Most of our core services (such as the Exchange Service) are subject to strict and specific laws and regulations that require us to collect, use and store certain personal data and process personally identifiable information and in some cases sensitive personal data (including biometric information) (see Section I for details) such as compliance with Know Your Customer (“KYC”) obligations under applicable laws and regulations, in particular compliance with anti-money laundering laws and regulations. As part of our KYC obligations, we may share your personal data with third-party identity verification service providers. If you do not provide the personal information required by law, you may not be able to open an account, or we may have to close an account you have opened.

We comply with the EU Anti-Money Laundering Directive and the laws of the relevant EU Member States implementing that Directive, which require us to process information from your identity document, including your photograph and an image of your face (so-called “liveness”).

– Ensure the accuracy of your personal data

We process your personal data when you provide us with your identity document. We use artificial intelligence OCR technology to extract important data to ensure the accuracy of information and improve business efficiency. The OCR engine overcomes the limitations of traditional OCR and is able to extract data with a high degree of accuracy.

– Communicate with you about services and transactions.

We use your personal data to communicate with you regarding administrative or account-related information for the Bidmax U Services. We will communicate with you to keep you up to date with our Services, for example, to inform you of relevant security issues, updates, or to provide other transaction-related information. Without such communications, you may not be informed of important developments related to your account that may affect how you use our Services. You cannot opt ​​out of receiving critical service communications, such as emails or mobile notifications sent for legal or security purposes.

Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

– Conduct research and innovation.

We conduct surveys to learn more about your experience using our services. We also use your information to support research and development and drive innovation in our services and products. The information will also be used for marketing purposes.

Where required by applicable law, we use your personal information for marketing purposes based on your consent. When you consent to the processing of your personal information for a specific purpose, you may withdraw your consent at any time and we will stop processing your personal information for that purpose. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

When we perform profiling for marketing purposes, such as determining which services or promotions you may be interested in, such processing is based on legitimate interests.

Even if you opt out of marketing communications, trading account information and communications related to our business relationship will not be affected.

– Events (i) Hosting and/or organizing events.

Bidmax U hosts many live events throughout the year. For example, events such as Blockchain Week. If you register for one of our events and you are a user, we will access the information in your account in order to provide you with information and services related to the event. When registering for an event, you may be asked to provide further information.

If you are not a user and register for one of our events, we will collect the following information: name, email, company, job title, industry, address, phone number, dining preferences, social media domains, etc.

(ii) In some cases, you may pay to attend an event. In this case, we will access the information in your account to provide you with information and services related to the event and facilitate the ticket purchase process. You may be asked to provide more information when registering for an event.

(iii) If you are a host at one of our events, we will collect your information, including your name, employer and contact information, and photo, and we may also collect information provided by event participants who evaluate your performance as a host. In some cases, we may also record and store your voice and likeness.

(iv) Some of our events are sponsored events. Bidmax U may provide a list of attendees to the sponsors, co-sponsors and exhibitors of our events. Bidmax U may also allow sponsors, co-sponsors, exhibitors or other third parties related to the organization of the event to send you materials by mail once per sponsored event, in which case Bidmax U will hire a third-party mailing company and will not share your mailing address directly with the sponsors/exhibitors. If you do not want your information to be included in the attendee list or do not want to receive information from sponsors, co-sponsors and/or exhibitors, you can express your preference when registering for the event or contact Bidmax U directly at dpo@binance.com. We do offer attendees the option to not receive marketing information from sponsors or Bidmax U.

(iv) Provide you with information about the event you have registered for, such as event updates and possible changes, cancellations or similar information.

(v) Fulfill and monitor our legal obligations, such as those under public safety regulations

(vi) Communicate with you about other events, news and services we offer, in accordance with your preferences

We rely on your consent to process your personal information for marketing purposes. When you consent to the processing of your personal information for a specific purpose, you can withdraw your consent at any time and we will stop processing your personal information for that purpose. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.

When you decide to attend an event or act as a host at an event, we process your personal data for your attendance at the event based on your consent. When you consent to the processing of your personal data for a specific purpose, you can withdraw your consent at any time and we will stop processing your personal data for that purpose. If you are a host at one of our events, in certain circumstances we may also take photos, make and store recordings of your voice and likeness. In these cases, Bidmax U relies on the legitimate interest basis to collect, store and process this personal data. When we organize events and work with sponsors, co-sponsors and exhibitors and send materials, we rely on your consent to send you materials or direct marketing emails about the event. When you consent to the processing of your personal data for a specific purpose, you can withdraw your consent at any time and we will stop processing your personal data for that purpose.

Where required by applicable law, we place cookies and similar technologies based on your consent. 4. Can children use Bidmax U services?

Bidmax U does not allow anyone under the age of 18 to use the Bidmax U Services, and we do not knowingly solicit or collect information from anyone under the age of 18. If you are under the age of 18, please do not provide any personal information to the Bidmax U Services.

If a user or customer who submits personal information is suspected to be under the age of 18, Bidmax U will ask the relevant customer or user to close their account and will take steps to delete the personal information of that individual as soon as possible.

5. What are cookies and other identifiers?

We use cookies and similar tools to enhance your user experience, provide our services, enhance our marketing efforts, and understand how customers use our services so that we can make improvements. 6. How and why do we share your personal data?

We may share your personal information with third parties (including other Bidmax U entities) if we believe that sharing your personal information is in compliance with any contractual relationship with you (including the Bidmax U Terms and Conditions) or us, applicable law, regulation or legal process. When sharing your personal information with other Bidmax U entities, we will do our best to ensure that those entities adhere to this Privacy Statement, or follow practices that are at least as protective as those described in this Privacy Statement. For example, depending on where you live and the entity responsible for running KYC checks. For more information, please see Section 1.

We may also share personal information with the following persons or in the following circumstances:

Affiliates: The personal data we process and collect may be transferred between Bidmax U companies as a normal course of conducting business and providing services to you. Please see Section 1 “Bidmax U’s relationship with you” and Section 2 “What personal data does Bidmax U collect and process?”.

Third parties: We employ other companies and individuals to perform functions on our behalf. Examples include analyzing data, providing marketing assistance, processing payments, transmitting content, and assessing and managing credit risk. Third-party service providers only have access to the personal information they need to perform their functions, but may not use it for other purposes. In addition, they must process personal information in accordance with our contractual agreement and only as permitted by applicable data protection law. Your personal data may also be shared with a third party (i.e., another data controller) when exercising your right to data portability, as provided by applicable law. For more information on data portability, please see Section 10. When you use third-party services (such as when you connect your Bidmax U account with your bank account) or websites linked through our Services, the providers of those services or products may receive information about you that Bidmax U, you, or others shared with them. Please note that when you use third-party services or Bidmax U-affiliated services that are not governed by this Privacy Policy, their own terms and privacy policies will govern your use of those services and products.

Third-party independent controllers

In the scope of the services provided by Bidmax U, some third-party service providers may process your personal data as independent data controllers for their own purposes, which may include but are not limited to:

– Comply with legal or regulatory obligations under applicable law;

– Prevent criminal activity, fraud (including impersonation fraud), money laundering or other illegal activities by checking data against records of confirmed or suspected illegal activities; for this purpose, the service provider may use machine learning to perform analysis, statistical analysis and analysis of AML/CTF trends

– Onboarding of users as third parties’ own clients or customers;

– User identification required to respond to data subject requests;

– Establishment, exercise or defense of legal claims (where applicable).

The service providers rely on the legal basis for data processing disclosed in their respective privacy statements, which are accessible from their websites. Your personal data will not be processed for longer than is necessary for the processing purposes listed above and will be retained in accordance with the service provider’s retention schedule. You can request more information on the identity of the third-party service providers and their processing activities by contacting Bidmax U (see Section 10).

Legal Authorities or Legal Requests: We may share your information with courts, law enforcement agencies, regulators, attorneys or other third parties: (a) to comply with laws and legal obligations; (b) to establish, exercise or defend legal or equitable claims; (c) to respond to law enforcement and regulatory requests, including (1) when we are compelled to do so by a subpoena, court order, search or seizure warrant or similar legal process, or (2) an international law enforcement request pursuant to a Mutual Legal Assistance Treaty (MLAT) or Letter of Request; (d) to comply with one or more forms of the “travel rule” that require us to transfer your information to another financial institution, regulator or other industry partner; (e) when we believe in good faith that disclosure of personal information is necessary to protect the rights, property or safety of our customers, Bidmax U or others, including to prevent imminent physical harm or significant financial loss; (f) to investigate violations of our Terms of Use or other applicable policies; and (g) to detect, investigate, prevent or address fraud or credit risk, other illegal activity or security and technical issues, to report suspected illegal activity or to assist law enforcement in investigating suspected illegal or unlawful activity.

Business Transfers: As our business continues to develop, we might sell or buy other businesses or services. In such transactions, user information is generally one of the transferred business assets, but remains subject to the promises in any existing Privacy Notice (unless, of course, the user consents otherwise). Also, in the unlikely event that Bidmax U or substantially all of its assets are acquired by a third party, user information will be one of the transferred assets.

With Your Consent: We may also disclose your personal information as described in the notice we provide to you at the time of collection or before the information is shared, or in any other manner to which you consent.

7. International Transfer of Personal Information

To facilitate our global operations, Bidmax U may transfer your personal information to To locations outside the European Economic Area (“EEA”), the United Kingdom and Switzerland. The EEA includes the EU countries as well as Iceland, Liechtenstein and Norway. Transfers outside the EEA are sometimes referred to as “third country transfers”.

We may transfer your personal information to our affiliates, third-party partners and service providers located around the world. If we intend to transfer personal information to a third country or international organization outside the EEA, Bidmax U will put in place appropriate technical, organizational and contractual safeguards (including standard contractual clauses) to ensure that such transfers comply with applicable data protection rules.

We also rely on decisions of the European Commission, who have recognized that certain countries and regions outside the EEA ensure an adequate level of protection for personal information. These decisions are called “adequacy decisions”.

8. Is my information secure?

We have designed our systems with your security and privacy in mind. We have implemented appropriate security measures to prevent your information from being accidentally lost, used or accessed in an unauthorized manner, altered or disclosed. We strive to protect the security of your personal data during transmission and storage by using encryption protocols and software. We use physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of your personal data. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know.

Our security procedures mean that we may ask you to verify your identity to prevent unauthorized access to your account. We recommend that you use a unique password for your Bidmax U account that you do not use for other online accounts and that you sign out when you have finished using a shared computer.

9. What about advertising?

In order to provide you with the best user experience, we may share your personal data with our marketing partners for targeting, modeling and/or profiling and marketing and advertising. You have the right to object to the use of your personal data for direct marketing purposes at any time (see Section 10 below).

10. What are my rights?

Under applicable law, you have a number of rights in relation to privacy and personal data protection as described below. You have the right to request access to, correction and deletion of your personal data and to request data portability. You may also object to our processing of your personal data or ask us to restrict the processing of your personal data in certain circumstances. In addition, when you have consented to us processing your personal data for a specific purpose, you may withdraw your consent at any time. If you would like to exercise any of your rights, please contact us using the web form available here. These rights may be limited in certain circumstances – for example, when we can demonstrate that we have a legal obligation to process your personal data.

Right of access: You have the right to confirm that your personal data has been processed and to obtain a copy of it and certain information about its processing. Please refer to the FAQ for more information on how to access your account statement yourself. You can also check your device and IP address login information through the dedicated “Account Activity History” page here. Please note that you must be logged into your account to gain access;

Right to correction: You can request that incorrect personal data be corrected and also supplemented. You can also change the personal data in your account at any time.

Right to erasure: In certain circumstances, you can have your personal data deleted. Please refer to the FAQ for more self-help information on how to request account deletion yourself. Please note that in the case of account deletion, personal data may still be retained to comply with our legal obligations.

Right to object: You can object to our processing of your personal data for reasons related to your situation, for example, where we rely on legitimate interests or process your data for direct marketing purposes;

Right to restrict processing: In certain circumstances, you have the right to temporarily restrict our processing of your personal data, provided there is a legitimate reason. We may continue to process your personal data if necessary to defend legal claims or for any other exceptions permitted by applicable law;
